勞動部獲准加入全球隱私執法合作協議(Global CAPE)將與國際夥伴共同推動跨境隱私執法合作
為加強保障國人個資,勞動部於去(112)年底申請加入「全球隱私執法合作協議Global Cooperation Arrangement for Privacy Enforcement (Global CAPE)」,並在今(113)年3月接獲Global CAPE管理者—日本經濟產業省通知我方申請已獲通過,未來可望透過該協議與其他國際夥伴共同推動跨境隱私執法合作,強化國人個資的保障。
我國作為創始會員的「全球跨境隱私規則論壇(Global Cross-Border Privacy Rules Forum, Global CBPR Forum)」向來致力於促進受信任的資料流通、降低不必要的數位貿易障礙。隨著全球數位化趨勢不斷加速,資料跨境傳輸需求急遽增加,個資侵害事故的發生經常牽涉境外因素,須透過跨國司法管轄權間的互助合作,才能有效打擊不法、防止侵害擴大。為此,該論壇於去年10月發布Global CAPE,除論壇會員外,並邀請各國隱私執法機關(PEA)加入,以促進不同司法管轄權間的執法合作。
除我國外,加入Global CAPE的尚有美國、日本、加拿大、英國、韓國、菲律賓、新加坡、墨西哥、杜拜金融中心、百慕達等司法管轄權。未來我國PEA可望透過Global CAPE與各個國際夥伴針對隱私或個資保護的跨境執法、資訊分享、專業交流等事項進行互助合作,進一步強化民眾資訊隱私權保障,而與國際最新法制和實務動向接軌,為活絡跨境數位貿易奠定穩固基礎,並促進我國數位經濟蓬勃發展。
MOL Joins the Global CAPE to Facilitate Cross-Border Cooperation in the Enforcement of Data Protection and Privacy Laws with International Partners
To enhance the protection of personal data, the Ministry of Labor (MOL) applied to join the Global Cooperation Arrangement for Privacy Enforcement (Global CAPE) at the end of 2023. In March, 2024, notice of the verification and approval of the application was received from the administrator of the Global CAPE—the Ministry of Economy, Trade and Industry of Japan. In the future, enhanced cross-border cooperation in the enforcement of Data Protection and Privacy Laws with international partners can be expected as a result of this agreement, strengthening the protection of Taiwanese people's personal data.
The Global Cross-Border Privacy Rules (CBPR) Forum endeavors to promote trusted data flows and to eliminate unnecessary barriers in digital trade, and Chinese Taipei serves as one of the founding members of the Forum. As digitalization continues to accelerate around the globe, demand for international data transmission has increased sharply. Personal data infringement incidents often involve overseas factors, requiring mutual assistance and cooperation between jurisdictions from different nations to effectively combat illegal activities and reduce infringement. For this reason, the Global CBPR Forum published the Global CAPE in October, 2023 and invited Privacy Enforcement Authorities (PEAs) from different nations not limited to those of Forum members to facilitate cross-border cooperation around the world.
In addition to Chinese Taipei, other jurisdictions in the Global CAPE include the United States, Japan, Canada, the United Kingdom, South Korea, the Philippines, Singapore, Mexico, Dubai International Financial Centre, and Bermuda. This opens up opportunities for Taiwan’s PEAs to work with international partners on cross-border enforcement related to privacy complaints, data protection, data sharing, and professional exchanges. Such collaboration will enhance the protection of information privacy, align with international legal standards and practical trends, foster cross-border digital trade and boost Taiwan's digital economy.
